On 11 September 2014, two royal Decrees relating to the implementation, on the one hand, of the patent provisions (here) and, on the other hand, of the supplementary protection certificates provisions (here) in book XI, "Intellectual Property" of the Code of Economic Law were published in the Belgian Official Gazette.
These two Decrees provide an early entry into force on 22 September 2014 of several provisions of Book XI, including in particular the chapter on patents and the chapter on supplementary protection certificates. Other chapters will, a priori, enter into force on 1 January 2015, as planned by the royal Decree of 19 April 2014.
It is worth noting that there is no mention of the provision on the exclusive jurisdiction of the Commercial Court of Brussels for patents and supplementary protection certificates (Article XI. 337) in these Decrees. Article XI. 337 will enter into force on 1 January 2015, to allow the judicial order to take the necessary measures to such centralization.
